Suspension des garanties
"In time of public emergency which threatens the life of the nation and the existence of which is officially proclaimed, the States Parties to the present Covenant may take measures derogating from their obligations under the present Covenant to the extent strictly required by the exigencies of the situation, provided that such measures are not inconsistent with their other obligations under international law and do not involve discrimination solely on the ground of race, colour, sex, language, religion or social origin." (ICCPR - 4.1). The American Convention on Human Rights refers to "derogation" as to "suspension of guarantees" (ACHR - 27). In its section 33, The Canadian Charter of Rights and Freedoms provides for a mechanism of "exception" to the protection of rights guaranteed by the charter in the form of an express declaration passed by a legislative body to be in effect for five years (the so - called "notwithstanding clause"): "Parliament or the legislature of a province may expressly declare in an Act of Parliament or of the legislature, as the case may be, that the Act or a provision thereof shall operate notwithstanding a provision included in section 2 or section 7 to 15 of this Charter".
