  • "In time of public emergency which threatens the life of the nation and the existence of which is officially proclaimed, the States Parties to the present Covenant may take measures derogating from their obligations under the present Covenant to the extent strictly required by the exigencies of the situation, provided that such measures are not inconsistent with their other obligations under international law and do not involve discrimination solely on the ground of race, colour, sex, language, religion or social origin." (ICCPR - 4.1). The American Convention on Human Rights refers to "derogation" as to "suspension of guarantees" (ACHR - 27). In its section 33, The Canadian Charter of Rights and Freedoms provides for a mechanism of "exception" to the protection of rights guaranteed by the charter in the form of an express declaration passed by a legislative body to be in effect for five years (the so - called "notwithstanding clause"): "Parliament or the legislature of a province may expressly declare in an Act of Parliament or of the legislature, as the case may be, that the Act or a provision thereof shall operate notwithstanding a provision included in section 2 or section 7 to 15 of this Charter".
  • «Dans le cas o? un danger public exceptionnel menace l'existence de la nation et est proclam? par un acte officiel, les États parties au présent Pacte peuvent prendre, dans la stricte mesure o? la situation l'exige, des mesures dérogeant aux obligations prévues dans le présent Pacte, sous réserve que ces mesures ne soient pas incompatibles avec les autres obligations que leur impose le droit international et qu'elles n'entra?nent pas une discrimination fondée uniquement sur la race, la couleur, le sexe, la langue, la religion ou l'origine.» (PIDCP - 4.1)La Convention américaine des droits de l'homme se réfère à la «suspension des garanties» (CAmeDH - 27).L'article 33 de la Charte canadienne des droits et libertés prévoit la possibilité de déroger aux obligations contenues dans la Charte sous forme d'une déclaration formelle dont la durée de validité est de cinq ans : « Le Parlement ou la législature d'une province peut adopter une loi o? il est expressément déclar? que celle-ci ou une de ses dispositions a effet indépendamment d'une disposition donée de l'article 2 ou des articles 7 à 15 de la présente charte».
