An "ethnic group" is a group of people with a common history, tradition, ancestry, culture and usually speaking the same language. If, in addition, they can claim to be living on their ancestral territory (homeland) they may be identified as a "nation" and one can refer to their "national origin". People of common "ethnic origin" living in a country where they have never acquired the status of a nationhood are called "ethnic minorities." International human right instruments use the term "discrimination based on national origin". The distinction made among "ancestry", "ethnic origin", "national origin" or "place of origin" as prohibited grounds of discrimination is subtle. The European Convention on Human Rights prohibits discrimination based on "association with a national minority" ECHR - 14)
Un groupe ethnique est un groupe de personnes unies par une communauté de langue, de traditions, de culture et d'ascendance. On parle d'une «nation» quand on peut ajouter à cette description une communauté du territoire et une volonté de vivre ensemble. On se réfère à ce moment-là à l'«origine nationale» de quelqu'un. Les instruments internationaux des droits de la personne ne parlent que de la distinction «fondée sur l'origine nationale». Il est parfois très difficile de faire une distinction claire entre des termes tels que l'«ascendance», l'«origine ethnique», l'«origine nationale» ou le «lieu d'origine» quand il s'agit des motifs de discrimination. La Convention européenne interdit la distinction fondée sur «l'appartenance à une minorité nationale» (CEurDH - 14).
