  • "All are equal before the law..." (UDHR - 7) or "Every individual is equal before and under the law ..." (CCFR - 15(1)). In Canadian law, "the right of the individual to equality before the law" (Canadian Bill of Right, art. 1(b)) was interpreted as meaning "equality in the administration or application of the law by the law enforcement authorities and the ordinary courts of the land." (see A.G. Canada v. Lavell [1974] S.C.R. 1349, at 1366) Section 15 of the Canadian Charter of Rights guarantees that "Every individual is equal before and under the law and has the right to the equal protection and equal benefit of the law without discrimination...". The addition of the words "and equal benefit" of the law after "protection" extends equality rights to include provisions granting benefits as well as equal protection of the law. (See Bayefsky-Eberts: Equality rights and the Charter, p. 23, and Explanatory notes to the Consolidation of Proposed Resolution and Possible Amendments to the Constitution of Canada, January 12, 1981) Article 7 of the Universal Declaration states: "All are equal before the law and entitled without any discrimination to equal protection of the law. All are entitled to equal protection against any discrimination in violation of this Declaration and against any incitement to such discrimination."
  • L'article 15(1) de la Charte canadienne des droits et libertés stipule que «La loi ne fait acception de personne et s'applique également à tous, et tous ont droit à la même protection et au même bénéfice de la loi, indépendamment de toute discrimination,...». Ceci signifie, qu'en ajoutant les mots «et au même bénéfice de la loi», le législateur s'assurait que le droit à l'égalité engloberait autant la protection de la loi que le droit de bénéficier de prestations prévues par la loi (Voir Notes...) L'article 7 de la Déclaration universelle stipule que «Tous sont égaux devant la loi et ont droit sans distinction à une égale protection de la loi. Tous ont droit à une protection égale protection de la loi. Tous ont droit à une protection égale contre toute discrimination qui violerait la présente Déclaration et contre toute provocation à une telle discrimination.»
