  • Application of special crisis powers authorized by law in situations of "exceptional circumstances", such as "circumstances resulting from temporary factors of a generally political character which in varying degrees involve extreme and imminent danger, threatening the organized existence of a nation, that is to say, the political and social system that it comprises as a State, and which may be defined as follows: a crisis situation affecting the population as a whole and constituting a threat to the organized existence of the community which forms the basic of the State." (see Mrs. Questeaux' study on situation known as states of siege or emergency, UN Doc. E/CN.4/Sub.2/1982/15). Different judicial systems use different terms for "state of emergency": state of siege, state of alert, state of prevention, suspension of guarantees, martial law, special powers, public emergency, etc. Mrs. Questeaux recognizes three types of emergency situations: a serious political crisis (armed conflict and internal disorder); force majeure (natural disasters such as earthquakes, tidal waves, cyclones) or particular economic circumstances related to underdevelopment. Article 4 of the International Covenant on Civil and Political Rights states that "In time of public emergency which threatens the life of the nation and the existence of which is officially proclaimed, the States Parties to the present Covenant may take measure derogating from their obligations...".

La terminologie des pouvoirs de crise varie selon les systèmes juridiques (état de siège, d'urgence, d'alerte, de prévention, de guerre interne, de suspension des garanties, lois maritales, pouvoirs spéciaux, etc.) Mme Questeaux reconna?t trois situations d'exception : crise à caractère politique grave (conflits armés et troubles internes), cas de force majeure (cataclysmes divers), circonstances économiques particulières liées notamment au sous-développement. L'article 4 du Pacte international des droits civils et politiques stipule que «[d]ans le cas o? un danger public exceptionnel menace l'existence de la nation et est proclam? par un acte officiel, les États parties au présent Pacte peuvent prendre, dans la stricte mesure o? la situation l'exige, des mesures dérogeant aux obligations prévues .».
