  • Section 52 of the Constitution Act, 1982 provides that "The Constitution of Canada is the supreme law of Canada, and any law that is inconsistent with the provisions of the Constitution is, to the extent of the inconsistency, of no force or effect". The Constitution of Canada includes all Constitution Acts since 1867 and the amendments thereon. The Canadian Charter of Rights and Freedoms is Part I of the Constitution Act, 1982. Provinces and the federal government were obliged to pass laws containing amendments to their existing legislation to bring their laws in line with the provisions of the Charter, in particularly its section 15 (equality rights)
  • L'article 52 de la Loi constitutionnelle de 1982 stipule que «la Constitution du Canada est la loi suprême du Canada; elle rend inopérantes les dispositions incompatibles de toute autre règle de droit». La Constitution du Canada comprend toutes les lois constitutionnelles depuis 1867 encore en vigueur et les amendements relatifs. La Charte canadienne des droits et libertés fait partie de la Loi constitutionnelle de 1982. Les provinces et le fédéral ont d? adopter des lois portant amendement aux lois existantes afin de les rendre compatibles avec les dispositions de la Charte canadienne, notamment en ce qui concerne son article 15 (droits à l'égalité)
