  • Crimes, "whether committed in time of war or in time of peace as the are defined in the Charter of the International Military Tribunal, Nrmberg, of 8 August 1945 and confirmed by resolutions 3 (I) of 13 February 1946 and 95 (I) of 11 December 1946 of the General Assembly of the United Nations, eviction by armed attack or occupation and inhuman acts resulting from the policy of apartheid, and the crime of genocide . . ." (Convention on the non - applicability of statutory limitations to war crimes.. - 1); also "...the violation of the economic and political rights of the indigenous population" as expressly condemned in United Nations General Assembly resolutions 2184 (XXI) of 12 December 1966 and 2202 (XXI) of 16 December 1966 (same Convention, preamble). Universal Declaration, in its preamble, refers to "barbarous acts which have outraged the conscience of mankind" In terms of the Canadian Criminal Code, "crimes against humanity" means "murder, extermination, enslavement, deportation, persecution or any other inhumane act or omission that is committed against any civilian population or any identifiable group of persons, whether or not it constitutes a contravention of the law in force at the time an in the place of its commission, and that, at the time and in that place, constitutes a contravention of customary international law or conventional international law or is criminal according to the general principles of law recognized by the community of nations." (CC - 7(3.76)) Term "act or omission" "includes, for greater certainty, attempting or conspiring to commit, counselling any person to commit, aiding or abetting any person in the commission of, or being an accessory after the fact in relation to, an act or omission" (CC - 7(3.77)

Le Code criminel canadien définit le «crime contre l'humanité» comme suit : «assassinat, extermination, réduction en esclavage, déportation, persécution ou autre fait - acte ou omission - inhumain d'une part, comis ou non constitu? une transgression du droit en vegueur à l'époque et au lieu de une transgression du droit international coutumier ou conventionnel, soit ayant l'ensemble des nations.» (CC - 7(3.76)). «Sont assimilés à un crime contre l'humanité ou un crime de guerre, selon le cas, la tentative, le complot, la complicité après le fait, le conseil, l'aide ou l'encouragement .» (CC - 7(3.77))
