  • Proscribed discrimination by the Quebec Charter of Rights and Freedoms. Covers: nationality/citizenship, marriage, divorce, family status, name, residence, civil capacity (see Fountainhead Fun Centres Ltd. c. Ville de St-Laurent [1979] C.S. 132 à la p. 144). Discrimination based on "filiation, on fraternity and sorority, and on marital status" viewed either in absolute terms (no married men should apply) or in relative terms, in relationship to another identified person (no-spouse/no-relative employment rule) (see CDPQ v. Town of Brossard, S.C.C., 1988). Other human rights legislation prohibits discrimination based on "family or marital status", "parentage" (ICESCR - 10.3), or "marriage" or "marital status" (CEDW - 11.2)
