- Means any distinction, exclusion or preference that has the effect of nullifying or impairing equal enjoyment of rights. "All persons are equal before the law and are entitled without any discrimination to the equal protection of the law. In this respect, the law shall prohibit any discrimination and guarantee to all persons equal and effective protection against discrimination on any ground such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status." (ICCPR - 26). Human rights legislation (originally called anti-discrimination legislation) provides lists of "proscribed grounds" or "prohibited grounds" of discrimination and of areas of activities to which such proscriptions apply. Section 15(1) of the Canadian Charter of Rights and Freedoms provides: "Every individual is equal before and under the law and has the right to the equal protection and equal benefit of the law without discrimination and, in particular without discrimination based on race, national or ethnic origin, colour, religion, sex, age or mental or physical disability"

A cet égard, la loi doit interdire toute discrimination et garantir à toutes les personnes une protection égale et efficace contre toute discrimination, notamment de race, de couleur, de sexe, de langue, de religion, d'opinion politique et de toute autre opinion, d'origine nationale ou sociale, de fortune, de naissance ou de toute autre situation.» (PIDCP - 26). Les textes législatifs relatifs à la discrimination généralement contiennent une liste de «motifs de distinction illicite». L'article 15, paragraphe 1 de la Charte canadienne des droits et libertés, notamment, stipule que «La loi ne fait acception de personne et s'applique également à tous, et tous ont droit à la même protection et au même bénéfice de la loi, indépendamment de toute discrimination, notamment des discriminations fondées sur la race, l'origine nationale ou ethnique, la couleur, la religion, le sexe, l'age ou les déficiences mentales ou physiques».
